This Privacy Policy outlines how Actiwerks ("we," "us," or "our") collects, uses, and protects information when you use our Licensed Application.

By using the Licensed Application, you agree to the collection and use of information as described in this Privacy Policy, in conjunction with the applicable End User License Agreement (EULA):

• For iOS applications, the Apple End User License Agreement (EULA) applies.
• For Android applications distributed via Google Play, the Google Play Terms of Service apply.
• For web-based applications or services provided outside app stores, this Privacy Policy alone governs the use of the Licensed Application.

This Privacy Policy and the applicable EULA complement each other. In case of any discrepancies, the respective EULA shall prevail.

1. Interpretation and Definitions

• Company: Refers to Actiwerks, a trademark of Pavel Lahoda, located in Czech Republic.
• Application: The software program provided by the Company, designed for use on Apple devices, Android devices, or as a web-based service.
• Licensed Application: The Application licensed to you under the applicable EULA.
• Personal Data: Any information that relates to an identified or identifiable individual.
• Service: The Licensed Application and any related services provided by the Company.
• Usage Data: Data collected automatically through the use of the Licensed Application.
• User Content: Refers to any text, images, videos, audio, or other materials that users post, upload, submit, or share through the Services. By posting User Content, users grant the Company a license to use such content under the terms outlined in the License to Use User Content section.
• You: The individual using the Licensed Application.

2. Data Collection

We collect only the minimum necessary data required for the Licensed Application’s functionality. This may include:

• User-provided data, such as settings and preferences configured within the app.
• Automatically collected data, such as general device information and app usage metrics.

We do not collect sensitive personal information or track users beyond the scope of the application’s intended functionality.

• Enabling and improving the application's functionality, including adapting content to enhance user experience.
• Contacting users only when necessary for application-related inquiries or support.

4. User Responsibilities for Content

If you use the Licensed Application to create, upload, or link to content, you agree that:

• You will only use content that you have the legal rights to use.
• You will not upload or distribute content that promotes violence, hatred, terrorism, discrimination, or illegal activities.
• You are solely responsible for any consequences arising from your use of such content, including termination of your license without compensation and potential legal actions.

The Company is not responsible for any content you create, upload, or share through the Licensed Application.

5. License to Use User Content

By posting, uploading, or otherwise sharing content on or through the Application, you grant the Company a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, host, store, display, reproduce, modify, adapt, publish, distribute, and create derivative works of your content. This license enables the Company to operate, promote, and improve the Services, as well as to develop new ones.

You retain ownership of your content, and this license does not affect your rights to use your content elsewhere. However, you acknowledge that once your content is shared publicly, it may be viewed, used, or shared by others.

6. Data Retention and User Rights (GDPR Compliance)

The Company respects your privacy and complies with the General Data Protection Regulation (GDPR). You have the right to access, correct, or request the deletion of any private data collected and stored about you, such as account information, preferences, and other personally identifiable data. If you wish to delete your data, you can contact us at support@actiwerks.com, and we will process your request within a reasonable timeframe.

However, by posting, uploading, or sharing user content through the Application, you voluntarily choose to make it publicly available. As such, it is no longer considered private data under GDPR and is subject to the License to Use User Content. While your private data can be removed upon request, publicly shared content may remain available as part of the Services and may continue to be used, displayed, or distributed by the Company and other users as permitted under the granted license.

7. Changes to This Privacy Policy

We may update this Privacy Policy as necessary. Any changes will be posted within the Licensed Application or on our website.
